Terms
Terms Of Service
Terms that govern business customer access to AfterCheck.
Last updated:
Agreement
These Terms of Service govern access to and use of AfterCheck. By creating an account, accessing a workspace, using AfterCheck, or using an AfterCheck feedback link on behalf of a business, you agree to these Terms for yourself and, where applicable, for the business or organization you represent.
AfterCheck is a business-to-business service for collecting private post-experience feedback, managing follow-up, exporting data, and preparing integrations. It is not a public review platform and does not guarantee reviews, ratings, reputation outcomes, customer responses, revenue, or business results.
If a separate written agreement, order form, data processing agreement, or customer notice applies to your account, that document applies together with these Terms. If there is a conflict, the separate written agreement controls for that conflict. Unless a separate written agreement identifies another contracting party, AfterCheck is operated by Tyler Heshka.
The Privacy Policy explains how AfterCheck collects, uses, discloses, retains, and protects personal information. It applies together with these Terms.
Early Access And Product Changes
AfterCheck is pre-release and may be offered as early access, evaluation, local, preview, or limited commercial access. Features, limits, routes, integrations, pricing, documentation, and availability may change as the product matures.
Unless a separate written agreement says otherwise, AfterCheck is provided without a service-level agreement, uptime commitment, support response commitment, or guaranteed feature availability.
Accounts And Workspaces
You are responsible for keeping account access secure and for ensuring that each user in your workspace is authorized to access the business data shown in AfterCheck. You must provide accurate account, workspace, billing, and contact information and keep it current.
A workspace owner or administrator is responsible for campaigns, feedback requests, public profile settings, locations, next actions, API keys, webhook endpoints, exports, notification settings, plan posture, and any other workspace configuration.
You must notify us promptly if you believe an account, API key, webhook endpoint, export, or workspace has been compromised.
Business Customer Responsibilities
You are responsible for your customer relationships, customer notices, permissions, consent records, lawful basis for contacting customers, and use of any data you enter into or export from AfterCheck.
If you connect a third-party system such as Shopify, you are responsible for having authority to connect that system, for selecting only approved stores and data, and for giving any notices or obtaining any consents required for AfterCheck to process order or customer information for your workspace.
You must not use AfterCheck to collect, request, upload, or store health records, payment card numbers, bank account numbers, government identification numbers, children's data, special-category data, or other highly sensitive personal information unless a separate written agreement expressly allows that use.
Customer Feedback Data
As between you and AfterCheck, you retain ownership of the customer feedback, campaign data, request data, source attribution, exports, and similar business records you submit to or generate through AfterCheck.
You grant AfterCheck the rights needed to host, process, transmit, display, secure, troubleshoot, back up, analyze for product operation, and improve the service. We do not sell customer feedback data and we do not use feedback content to operate a public review platform.
Data Processing Terms
AfterCheck processes personal information submitted by you, your team, and your customers to provide the service. You decide what feedback requests to send, what customer information to enter, what public links to use, what exports to download, and what integrations to configure.
AfterCheck will process personal information according to these Terms, the Privacy Policy, and any separate written agreement that applies. You are responsible for complying with privacy, consumer protection, anti-spam, employment, industry, and other laws that apply to your business and customer communications.
- Categories: workspace, business user, team, campaign, request, response, feedback, note, export, API key, webhook, billing, support, analytics, security, and integration records, including Shopify customer name, email, order identifiers, and order timestamps when Shopify permits those fields.
- Purposes: providing private feedback workflows, workspace administration, support, security, troubleshooting, billing, analytics, provider operations, legal compliance, and enforcing these Terms.
- Instructions: AfterCheck processes customer and Shopify protected customer data for the service purposes described in these Terms, the Privacy Policy, workspace settings, enabled integrations, and any separate written agreement.
- Subprocessors: AfterCheck may use hosting, database, authentication, transactional email, marketing email, billing, connected-store, analytics, error monitoring, rate limit, webhook, support, legal, and infrastructure providers where needed to operate the service.
- Retention and deletion: deletion, export, and redaction requests may require support review and are subject to backup, security, legal, billing, tax, accounting, dispute, fraud-prevention, provider, and operational retention obligations.
- Security: AfterCheck will take reasonable steps to protect personal information using authenticated access, organization-scoped authorization, server-only secrets, hashed API keys, provider boundaries, security monitoring, and incident response procedures appropriate to the current product stage.
- Rights requests: AfterCheck may need to verify identity, workspace authority, store ownership, request scope, and retention obligations before assisting with access, correction, export, deletion, redaction, or Shopify privacy requests.
Customer Communications And CASL
If you use AfterCheck links, snippets, API features, email features, webhook features, exports, or other tools to contact customers, you are responsible for ensuring those communications are lawful. This includes any obligations to obtain consent, identify the sender, keep consent records, provide unsubscribe or preference mechanisms, and honour opt-out requests under Canada's Anti-Spam Legislation (CASL) and other applicable messaging rules.
AfterCheck may help generate feedback links or deliver configured notifications, but AfterCheck does not determine whether you have permission to contact a particular person.
Review-Gating And Acceptable Use
AfterCheck is feedback-first. You must not use AfterCheck to suppress criticism, manipulate public review outcomes, route only positive feedback to public review sites, hide neutral or negative feedback paths from customers, or otherwise operate a review-gating workflow.
You also must not use AfterCheck to:
- send unlawful spam or contact people without required consent;
- upload purchased, scraped, or unauthorized contact lists;
- harass, threaten, deceive, or discriminate against customers;
- collect highly sensitive data without a separate written agreement;
- submit malware, exploit code, or unlawful content;
- probe, bypass, or interfere with authentication, rate limits, security controls, provider controls, or tenant boundaries;
- resell, white-label, or commercially sublicense AfterCheck without written permission;
- use AfterCheck to train or operate a competing product without written permission;
- use the service in a way that violates applicable law.
Integrations, API Keys, Webhooks, And Exports
API keys, exports, and webhooks are data portability and integration tools. You are responsible for protecting API keys, choosing safe webhook endpoints, securing systems that receive exported data, and limiting access to people who need it.
Some integration and delivery features may be local-only, preview, gated, planned, or disabled unless the required configuration is present. You must not claim that live email, webhook, billing, or other provider delivery is active unless that provider is actually configured and enabled for your workspace.
If you connect Shopify, you authorize AfterCheck to use the Shopify permissions approved for your store, including protected customer data fields that Shopify permits for the connected app, to create and manage AfterCheck feedback request records. Current Shopify order-triggered requests are created as not-sent records and do not automatically email customers from Shopify order events.
Do not connect a production Shopify store or rely on the Shopify integration for live customer workflows unless that environment, protected data approval, webhook setup, and support process have been approved for your use. AfterCheck may disconnect, degrade, or pause an integration if permissions are revoked, the app is uninstalled, required setup is missing, or continued operation creates legal, privacy, security, provider, or product risk.
Plans, Billing, And Payments
AfterCheck may offer Free, paid, managed, or early-access plans. When self-service billing is enabled, Stripe Checkout and Stripe Customer Portal are the hosted payment, payment-method, invoice, plan-change, and cancellation surfaces. Stripe processes payment data. AfterCheck stores billing contacts, plan and subscription state, and support-safe Stripe identifiers and webhook receipts; it does not store card numbers, bank details, payment method details, or raw Stripe webhook payloads.
Fees, taxes, renewal terms, cancellation terms, refund terms, required internet-sales disclosures, and any order-form terms will be provided before purchase or in the applicable written agreement. Unless an order form says otherwise, fees are non-refundable except where required by law. A return from Stripe Checkout or the Stripe Customer Portal does not by itself prove payment, cancellation, or plan state; AfterCheck relies on verified provider state and webhook processing.
Service Availability And Support
During early access and pre-release use, AfterCheck is provided on an "as available" and "as is" basis. We may change, suspend, limit, or discontinue features where needed for security, maintenance, provider changes, legal reasons, abuse prevention, or product development.
Support requests can be sent to support@aftercheck.app. Support response times are not guaranteed unless a separate written agreement provides one.
Intellectual Property
AfterCheck and its software, design, workflows, documentation, brand assets, service content, and related intellectual property are owned by AfterCheck or its licensors. These Terms do not transfer any intellectual property rights except the limited rights needed for you to use the service as permitted.
You retain rights in your business content and feedback data, subject to the processing rights described in these Terms.
Confidentiality And Security
Non-public product information, security details, source code, roadmap details, pricing terms, customer data, API keys, webhook details, and workspace records may be confidential. You must use reasonable care to protect confidential information and must not disclose it except as permitted by these Terms or a separate written agreement.
You must not attempt to access data that does not belong to your workspace. You must promptly report suspected security issues, unauthorized access, or compromised credentials.
If AfterCheck identifies a security or privacy incident that may affect your workspace, customer data, Shopify protected customer data, or service access, AfterCheck will assess the incident and take reasonable steps to notify affected parties where required by law, provider requirements, these Terms, or a separate written agreement.
Third-Party Services
AfterCheck may rely on third-party providers for hosting, database, authentication, transactional email, marketing email, billing, connected-store integrations, analytics, error monitoring, rate limiting, webhook delivery, and other infrastructure. Third-party services may change over time. Some features may be unavailable if a provider is disabled, misconfigured, unavailable, not approved, or not included in your environment.
Depending on configuration, providers may include Vercel, Supabase, Resend, Klaviyo, Stripe, Shopify, PostHog, Sentry, Upstash, Svix, GitHub, DNS/email providers, professional advisors, and support or legal vendors. Provider use does not remove your responsibility to protect exports, API keys, webhook destinations, and downstream systems that you control.
Suspension And Termination
We may suspend or terminate access if you violate these Terms, create security or legal risk, fail to pay amounts owed under a separate paid agreement, misuse customer data, infringe intellectual property, or use AfterCheck in a way that harms the service, customers, providers, or other users.
You may stop using AfterCheck at any time. Data export or deletion may require a support-reviewed request in the current product. Account and workspace deletion request records, blocker checks, and scheduled recovery states may exist, but final account deletion, final workspace deletion, Auth user deletion, hard deletion, Stripe cancellation automation, and billing/legal contact transfer are not guaranteed self-service features unless a separate written agreement or released product policy says so.
Retention, backup, security, legal, audit, fraud-prevention, tax, accounting, support, dispute, and provider obligations may limit or delay deletion or require AfterCheck to keep certain records.
Disclaimers
To the maximum extent permitted by law, AfterCheck disclaims all warranties that are not expressly stated in these Terms or a separate written agreement, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, security, data availability, or any particular business outcome.
Limitation Of Liability
To the maximum extent permitted by law, AfterCheck will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost goodwill, lost data, business interruption, or substitute services.
Unless a separate written agreement states a different cap, AfterCheck's total liability for claims relating to the service is limited to the greater of the amounts you paid to AfterCheck for the service in the three months before the claim or CAD $100.
Indemnity
You will defend, indemnify, and hold AfterCheck harmless from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the service, your customer communications, your data, your integrations, your breach of these Terms, or your violation of applicable law.
Governing Law And Venue
These Terms are governed by the laws of Saskatchewan and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Unless a separate written agreement says otherwise, disputes will be brought in the courts located in Saskatchewan, Canada.
Changes To These Terms
We may update these Terms as AfterCheck changes. The "Last updated" date shows when the Terms were last revised. Continued use of the service after an update means you accept the revised Terms. Material changes may be announced in the app, by email, or through another reasonable notice path.
